Pakistan seeks inadmissibility of Indian plea Posted

A State Department spokesperson said, "We believe India and Pakistan stand to benefit from practical cooperation".

Deepak Mittal, joint secretary of India's Ministry of External Affairs, told judges at the ICJ that Jadhav's death sentence was handed down following a "farcical" trial.

As the ICJ began hearing Jadhav's case, India argued that human rights treated as "basics" all over had been thrown to the wind by Pakistan.

Harish Salve, leading the Indian legal team, had focused his arguments on Pakistan's denial of consular access to Jadhav as he presented India's case before the judicial body.

ICJ president Ronny Abraham, after hearing arguments from both sides, said that the verdict would be announced "as soon as possible" and the date "duly communicated".

Incidentally, Pakistan has accused Indian national Kulbhushan Jadhav of spying without providing consular access to India and without any evidence.


The case is likely to take months or years to resolve, so India is asking the ICJ immediately order Pakistan to "take all measures necessary" to prevent Jadhav's execution pending the final outcome. New Delhi insists Jadhav is a retired officer of the Indian Navy and was kidnapped from Iran, where he was involved in business activities. India denies that he has any connection with the government.

Dr Muhammad Faisal told the court that under Vienna Convention the ICJ could not take up this case. He said India's application is misconceived and unnecessary. A report published by United Nations Committee against Torture last week said Islamabad should stop resorting to military courts for terrorism-related prosecutions. He said Indian Naval Commander Jadhav was arrested by Pakistani forces during an operation in Balochistan and he confessed killing of dozens of innocent Pakistanis.

India urged the court to pass directions so that Pakistan takes no action that might prejudice the rights of India and Jadhav till a decision is taken by the global court. Leading the Indian legal team, senior advocate Harish Salve focused on denial of consular access to Jadhav, in breach of the 1963 Vienna Convention on Consular Relations. We submit that India's silence is telling.

Dismissing India's contention that it invoked the jurisdiction of the court because of the "imminent" possibility of execution of Jadhav, Qureshi said the court was bound to settle disputes between countries peacefully and not waste time on issues sought to be raised for political objective. "For one year, India made not one or two but 16 attempts to get the consular access", sources said.

Pakistan claims to have arrested Jadhav from its restive Balochistan province.

Pakistan's DG for South Asia and Saarc, Mohammed Faisal, said, "India was provided with a copy of the passport that was in the possession of Commander Jadhav when he was apprehended".
