Cross-claim submitted after violence at Trump campaign rally

A man who has been accused in a lawsuit of assaulting a protester at a Donald Trump campaign rally in Louisville a year ago has filed a counter suit against the president, claiming that he would never have acted the way he did without Trump's "urging and inspiration".

According to the lawsuit filed Friday, at at least one rally, Trump or his campaign promised to pay the legal fees of those who followed Trump's urgings to remove the protesters, according to WDRB.

Alvin Bamberger, a 75-year-old Trump supporter who was captured on video pushing Nwanguma, filed a suit Friday against Trump.

During court proceedings that President Trump would rather see disappear, attorneys are making the argument that violence which occurred at a Trump rally in 2016 was directly related to the comments made by the then-candidate.

Attorneys for Trump had argued that he did not want his supporters to use force when he declared "get 'em out of here" at the Louisville rally, but a federal judge in the case ruled earlier this month that the case can proceed because there is no protection for speech that incites violence. During the altercation, Trump shouted at them to "get out" and "get 'em out of here!" The lawyers also said Trump's "get them out of here" remark wasn't directed to the crowd.

President Trump's lawyers on Friday argued that the commander-in-chief is immune from civil lawsuits and can not be sued for inciting violence during Trump rallies.

If he is held liable for his actions, Pence argued in the counter-claim, it is because Trump and his campaign "inspired Bamberger to act as he did".


During the rally, Trump allegedly instructed his supporters to "get them out of here" while they were peacefully protesting at the Kentucky International Convention Center.

"[Bamberger] denies that he assaulted that woman, lacks knowledge or information sufficient to form a belief as to the woman's identity, and denies the characterization of his actions as "most aggressive" or 'shoving. and striking, '" the cross claim reads.

And they said Trump told security, "Don't hurt them".

Pence also wrote that Bamberger admits he touched the woman, but did not "assault" her.

All three men have been charged with harassment with physical contact Nwanguma.

A criminal summons is signed by a judge and states the crime the person has been accused of and orders them to appear in court.
