ICE Releases List Of Sanctuary Jurisdictions Set To Lose Federal Funding

During a one-week period, Travis County denied the most federal immigration requests of anywhere in the country, according to a report issued Monday, adding more fuel to the debate around sanctuary cities.

"When law enforcement agencies fail to honor immigration detainers and release serious criminal offenders, it undermines ICE's ability to protect the public safety and carry out its mission", he said. A detainer is a request from ICE for local authorities to hold an inmate for up to 48 hours beyond the normal release time-to allow handover to ICE. Travis County's sheriff has vowed to not cooperate with ICE and Texas Gov. Gregg Abbott has restricted some law enforcement funding from the jurisdiction.

Such cities and counties, commonly described as "sanctuary jurisdictions", may not cooperate with the detainer requests for a variety of reasons. Bastrop County declined three requests and Williamson County declined four.

The report is the first "Declined Detainer Outcome Report", which are required to be released weekly under an executive order issued in January by President Donald Trump.


ICE arrested 51 people in the Austin area thought to be in the United States illegally in mid-February, and records obtained by the KVUE Defenders show 28 of them had no criminal history. Avideh Moussavian, a staff lawyer at NILC, said police often cooperate with federal law enforcement agencies on criminal matters, but emphasized that immigration violations are civil, not criminal.

In his January 25 executive order intensifying deportation efforts, President Trump said the Homeland Security secretary should compile a list of the agencies that refused to detain immigrants past the time they are supposed to be released and the crimes those immigrants are accused of, and make it public "on a weekly basis".

Some field offices had ceased issuing detainers to known uncooperative jurisdictions, according to ICE.

There are also concerns about due process. It doesn't represent all the cases in which immigration authorities sought custody of people facing criminal charges, with major cities like NY and Los Angeles underrepresented on the list. "We will continue collaborating with them to help ensure that illegal aliens who may pose a threat to our communities are not released onto the streets to potentially harm individuals living within our communities".
