Appeals court will vote on rehearing ban ruling

Executive power isn’t absolute power

On Thursday, the panel of three judges with the extremely liberal San Francisco-based Court delivered a unanimous decision that upheld a temporary restraining order suspending Trump's travel ban from seven Muslim-majority nations.

"We'll be doing something very rapidly having to do with additional security for our country".

"Ultimately, I have no doubt that we'll win that particular case". "And we will do whatever we need to do consistent with the law to keep this country safe", Miller said. It will happen rapidly.

But lawyers for the U.S. government in Virginia wrote that "judicial second-guessing" amounted to "an impermissible intrusion" on Mr Trump's constitutional authority.

The White House filed papers Monday to formally appeal last week's federal court ruling that upheld a suspension of President Trump's travel ban.

Signed by President Donald Trump last month, it temporarily halts the admittance of refugees into the U.S. and prevents immigrants from seven predominantly-Muslim countries from coming to the U.S. However, enforcement of the Order is on hold. The travel ban, which he enacted at the end of his first week in office, caused chaos at U.S. airports and gave rise to widespread protests.

The measure - given with no notice - set off detentions of incoming travelers, protests at airports and worldwide condemnation until a federal judge in Seattle stepped in and suspended the order a week later.

Abe said that he looked forward to playing golf with Trump at his Mar-a-Lago estate in South Florida, and conceded: "My scores in golf is not up the level of Donald at all".

The judge may disagree with the decision and want a reversal; want the imprimatur of the full court on the ruling; or want a vehicle for judges who disagree with the ruling to express their displeasure.

"I have trouble understanding why we're supposed to infer religious animus when, in fact, the vast majority of Muslims would not be affected", Judge Richard Clifton, a George W. Bush nominee, asked an attorney representing Washington state and Minnesota.

But minutes later the author of the blog article, Benjamin Wittes, tweeted a suggestion that Trump had taken the quote out of context.

Martosko said he wasn't sure whether Trump had the earpiece in earlier, during the beginning of the press conference.

But in the appeals court's damning assessment of Trump's case it stated "the government has pointed no evidence that any alien from any of the countries named in the order has perpetrated a terrorist attack in the United States".

The Justice Department said in a statement it is "considering its options" in response to Thomas' request.

Should it write a new order, it would be more narrowly tailored than the one issued two weeks ago, the source said, such as explicitly stating that it does not apply to legal permanent residents.
